Viatris filed a lawsuit against Novo Nordisk in Delaware federal court, seeking a ruling that its planned generic version of Wegovy would not violate the Danish company's patent rights.
Mylan Pharmaceuticals, a unit of Viatris, asked the court on September 24 to rule that its generic product does not infringe a Novo Nordisk patent. The patent covers a method of administering single-dose Wegovy pens for weight loss.
Novo Nordisk generated nearly $31 billion last year from its semaglutide-based weight-loss medications Wegovy and Ozempic. Generic versions of both treatments cannot enter the US market until 2032, when patents on the active ingredient expire.
Novo Nordisk has previously settled patent lawsuits regarding proposed Wegovy and Ozempic generics with Mylan and other drugmakers.
